Traffic Deferrals

The Decatur County Prosecuting Attorney’s Office has an infraction deferral program, under Indiana Code 34-28-5-1(f), available for those who have been cited for some infraction offenses. When a person completes this program, the infraction ticket is dismissed and no judgments or points will be noted on the person’s driving or court record. The length and cost of the program depends on the nature of the offense.

 If you have already paid the ticket, this offer is invalid.

To participate in this program:

  • The defendant cannot have committed any moving traffic violation in the past 13 months.

  • The defendant cannot have a CDL.

  • If the defendant lives out of state, they must provide their driving record.

Should you be eligible, a letter with this offer may be mailed to you, or you may call to inquire about your eligibility.

If you choose to participate you must:

1.  Provide the requested information and sign the deferral agreement.

2. Include a money order with the agreement payable to  the Decatur County Clerk of Courts.

3.  Mail the agreement and the money order to this office at 150 COURTHOUSE SQUARE, #229 Greensburg, IN 47240-2031.

4. Obtain and maintain a valid driver’s license.

5. Do not commit any moving traffic violations for the next six months.

Upon completion:

  • No points against your driving record

  • Dismissal of ticket

  • Insurance rates may not increase
